Localler Reward Program – Commission Rebate

1. Program Overview

To recognise and reward active and high-quality Locallers - (that’s YOU!), Localmingo offers a Localler Reward Program - Commission Rebate (“Program”) for Locallers who successfully complete multiple tours within a defined period, subject to the terms below.

2. Program Validity

This program is valid until 31 December 2026 (“Validity Period”).

This Program applies to all local guides and hosts who have registered a Localler’s Account and have been successfully approved and onboarded as Locallers by Localmingo during the Validity Period.

3. Successful Tours

A Localler must complete the specified number of Successful Tours to be eligible for a Commission Rebate, as further set out in paragraphs 4 and 5 below.

A tour/experience booked through Localmingo (“Tour”) is considered a “Successful Tour” if it meets all of the following conditions during the Validity Period:

  • The Tour:
    • is confirmed, delivered, and completed by the Localler
    • is paid in full by the Mingoer (customer)
    • is not cancelled, refunded (fully or partially), or subject to chargeback
    • is not under dispute
    • does not receive material negative feedback or complaints, as determined at Localmingo’s discretion

The payment of the Commission Rebate is subject to the Localler’s Account remaining in good standing, and the Localler complying with Localler Terms of Service and all other Localmingo’s platform standards and policies.

4. 20% Commission Rebate Upon Completion of 3 Successful Tours

A Localler who completes three (3) Successful Tours will receive a Commission Rebate equal to twenty percent (20%) of the commission charged by Localmingo in respect of the three (3) qualifying tours completed during the Validity Period.

For example, if Localmingo charges a total of AU$300 in commission across 3 qualifying tours, the Localler will receive a Commission Rebate of AU$60.

5. 10% Commission Rebate for Future Tours

Upon:

  • Completion of three (3) Successful Tours, and
  • Successful payment transfer of the 20% Commission Rebate to the Localler;

The Localler will enjoy Commission Rebate equal to ten percent (10%) of the commission charged by Localmingo for ALL future Successful Tours during the Validity Period.

For example, if Localmingo charges AU$300 in total commission across all qualifying tours under this clause in a month, the Localler will receive a Commission Rebate of AU$30.

6. Assessment & Notification

Eligibility assessments of Commission Rebate will be conducted on a monthly basis:

  • Localmingo will assess rebate eligibility within fourteen (14) calendar days following the end of the applicable calendar month.
  • Eligible Locallers will be notified by email of the assessed Commission Rebate, and, if they are receiving a Commission Rebate from Localmingo for the first time, must provide their bank account details within seven (7) calendar days to receive the payment.
  • Localmingo will pay the Commission Rebate to the Localler’s nominated bank account within seven (7) calendar days after the later of (i) the date of notification or (ii) receipt of the required bank account details, by bank transfer or such other payment method as Localmingo deems appropriate.

If the Localler’s payout currency differs from the platform’s currency, the Commission Rebate will be converted at the applicable exchange rate as determined by Localmingo, and the final amount received may vary due to currency conversion.

Regarding the chargebacks and timing consideration, the following requirements are applied:

  • Due to payment provider and card network rules, chargebacks may be initiated up to approximately 180 days after a transaction;
  • To ensure a timely and positive experience for Locallers, eligibility will be assessed based on the status of Tours at the time of the monthly assessment;
  • Where no refund, dispute, or chargeback exists at the time of assessment, a Tour may be provisionally deemed successful, and the applicable Commission Rebate may be applied;
  • Localmingo reserves the right to reverse, recover, or adjust any Commission Rebate, and set off such amounts against any future Commission Rebates if a refund, dispute, or chargeback subsequently arises in connection with any qualifying tour.

7. End of Commission Rebate Payment

All Commission Rebates under this Program will automatically cease to apply to any Successful Tour completed after the expiry of the Validity Period, without further notice.

Localmingo reserves the right, at any time during the Validity Period, to withhold, suspend, reduce, cancel, or recover any Commission Rebate, or to remove a Localler from participation in this Program, where Localmingo reasonably determines that such action is appropriate, including (without limitation) where:

  • a dispute, refund, or chargeback arises in relation to any Tour;
  • the Localler receives material negative feedback, complaints, or ratings; or
  • the Localler breaches the Localler Terms of Service or any of Localmingo’s policies, standards, or guidelines.

8. General Conditions

Non-Transferability

  • The Commission Rebate is personal to the eligible Localler and is non-transferable, non-assignable, and may not be exchanged for any other benefit.

Finality of Decisions

  • Localmingo’s decisions are final and binding in all matters relating to this Program, including (without limitation) the assessment and eligibility of Commission Rebates, Tour eligibility, dispute status, the existence of material negative feedback, the applicable Validity Period, and a Localler’s participation in the Program.

Exclusion and Limitation of Liability

  • To the maximum extent permitted by law, Localmingo excludes all liability arising out of or in connection with this Program. Where liability cannot be excluded, Localmingo’s total aggregate liability to a Localler for any loss, damage, or claim (whether in contract, tort, negligence, or otherwise) shall be limited to the amount of the Commission Rebate payable (if any) to that Localler under this Program.

Indemnity

  • The Localler indemnifies and holds harmless Localmingo, its officers, employees, and agents from and against any loss, damage, liability, cost, or expense (including reasonable legal costs) arising out of or in connection with any act or omission of the Localler, including any breach of this Program, the Localler Terms of Service, or applicable laws, or any claim made by a third party relating to the Localler’s Tours or conduct.

Program Administration and Rights

  • Localmingo reserves the right, at its sole discretion, to:
    • verify all Tour records, payment statuses, completion records, and feedback relevant to this Program;
    • withhold, reverse, recover, adjust, or offset any Commission Rebate issued in error, including where such error results from incorrect data, system issues, refunds, disputes, or chargebacks; and
    • modify, suspend, shorten, extend, or terminate this Program or the Validity Period, in whole or in part, at any time, without prior notice and without providing reasons, subject to applicable law.

Governing Law and Jurisdiction

  • This Program and any dispute or claim arising out of or in connection with it are governed by the laws of the State of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of that State.
